Leaders of Mexico Forum – The Role of the Mexican Supreme Court in the Reshaping of Family Law: The Analysis of Three Landmark Cases

Justice José Ramón Cossío Díaz, from the Supreme Court of Justice of the Nation, will discuss three landmark cases that have reshaped family law in Mexico.  Justice Cossío Díaz has been a fundamental voice in the Mexican Supreme Court’s rulings that have turned state legislatures’ efforts to ban gay marriage and adoption unconstitutional. In fact, during the last years, the Court has dramatically reshaped family law in Mexico. In the 2010, the Court upheld the reforms to allow equal marriage and adoption by gay and lesbian couples in Mexico City. Over the next years, the Court issued several opinions that gradually reduced the scope of state legislations that defined marriage as the union of a “man and a woman” with the objective of “perpetuating the species.” This process reached a high peak last June, when the Court finally published three binding criteria that establish that any state legislation that prohibits equal marriage is unconstitutional.

José Ramón Cossío was born Mexico City. He studied law at the University of Colima and holds Masters degrees from the National Autonomous University of Mexico and from Complutense University in Madrid, where he also obtained his doctoral degree. He has taught constitutional law at the Autonomous Institute of Technology of Mexico, where he also headed the Law Faculty. In 2003, he was nominated for the Supreme Court by President Vicente Fox, and confirmed by the Senate, becoming one of the youngest justices in the Court’s history.
